The FCT High Court in Kubwa has ruled to strike out a N1 billion lawsuit against Abubakar Malami, former Minister of Justice and Attorney-General of the Federation, citing lack of diligent prosecution by the claimant.
The lawsuit, initiated by Abuja-based property developer Cecil Osakwe, also targeted Ms. Asabe Waziri and the offices of the former minister and the Federal Ministry of Justice.
Presiding Judge Oluyemisi Adelaja emphasized Osakwe’s absence in court without valid explanation as grounds for the dismissal under Order 32 Rule 4.
Recalling events from June 2022, the Federal Government had filed charges against Osakwe for advance fee fraud and criminal intimidation against Waziri.
In response, Osakwe initiated a lawsuit against Malami, seeking N1 billion in punitive damages and N100 million in general damages.
However, due to Osakwe’s failure to diligently pursue the case, it was struck out by the court.
